Soli Deo Gloria....."Only in GOD we trust."


Preamble: The recent outcome in sentencing of Oscar Pistorius has left a very bitter taste , let alone an emotional trauma that will be embedded forever!
My criticism is just not on the jurisprudence in South Africa, but a concomitant of factors that leads to bigoted outcomes that are prejudicial.

Firstly, I would like to elaborate on the fact that the South African constitution promotes the right to life. Hence we have no death penalty either as a form of deterrent nor as one of vengeance.
Having due regard for the judicial system in our country , it is stymied by prejudice where affirmative action has been the forefront of Black advancement, irrespective of quality! Thokizile was appointed to the High court bench in 1998.
One such case is none other than the so called "Honourable" Judge Thokozile Masipa who presided over the Oscar Pistorius Trial together with two assessors, One black and the other white....shall I call this window dressing?
Thokozile was a social worker and a crime reporter before enrolling at the University Of South AFRICA, a distance learning university, with standards that are laughable!! But so be it.

Clearly this Honourable Judge has misinterpreted the law as well as case laws wherein a verdict of Dolus Eventualis (murder with intent) should have been the outcome. The case was not strong enough for Dolus Directus( pre-meditated murder).

Even though there was a huge outcry at he misjudgement, she further went on to add insult to injury where the final outcome was culpable homicide/manslaughter on the basis that Oscar acted hastily, and fired four shots with a lethal weapon and unconventional ammunition that was meant to kill!!!

Does this make sense?

Oscar would appear to have gained another GOLD MEDAL , this time in our courts of law. His sentence was a paltry 5 years imprisonment and under section 291 I , need only serve 10 months in prison and the rest under house arrest serving sixteen hours per week as social work !

Makes one wonder , doesn't it...murder someone , get the best defence Advocates and a DUMB JUDGE and a rainbow spectrum of assessors who don't know their a** from their elbow and voila you laugh all the way in your orange prison overall!

I think it's time for Thokozile Masipa to retire without causing further misery in our judicial system.
Incidently , this is the same clown who sentenced a serial r******st to 252 years imprisonment ! Who ever lives for that long ???
This woman needs serious counselling.


PS: I would not be surprised if the National Prosecuting Authority( NPA) appeals the outcome of the judgement , not only because of the error in judgement , but also if uncontested this may be used in any future case laws which has the same bearing.
